 PETITION FOR LEAVE TO APPEAL STILL PENDING
Dear Steel Industry employer

 

As previously communicated, NEASA has filed a petition for leave to appeal at the Labour Appeal Court (LAC) in order to obtain leave to appeal the judgement of the Labour Court, which dismissed NEASA’s application to temporarily interdict the extension of the MEIBC’s Consolidated Main Agreement to non-parties, pending the finalisation of a review into the decision making process of the MEIBC.

 

To date, the LAC has not yet ruled on the petition for leave to appeal which results in the matter being stalled for the moment.

We remain of the view that the Labour Court made fundamental errors in its reasoning in dismissing NEASA’s urgent application and will exhaust all avenues in our attempt to correct this.
