Dear Chemical Industry employer
The National Bargaining Council for the Chemical Industry regulates various sectors related to the chemical industry.
According to the registered scope of the Council, it has jurisdiction over the following sectors:
- Chemically related consumer goods
- Glass
- Industrial Chemicals
- Petroleum
- Pharmaceuticals
The Council has for many years negotiated agreements relating to conditions of employment between employer- and union parties to the Council, but has not extended these agreements to non-parties.
The Council has now started to extend its collective agreements to non-parties and has extended all agreements, with the exception of the Industrial Chemicals agreement, which will, no doubt follow soon.
WHAT DOES THIS MEAN?
The effect of these extensions is that every employer whose activities fall within the scope of the Council is now bound by these agreements and will be expected to comply with the provisions thereof.
These provisions include prescribed minimum wages, bonus payments, leave provisions etc., all of which will massively increase the cost for employers.
Agents of the Council have already issued compliance orders against a number of employers to enforce compliance.
Compliance with these agreements will be unaffordable for many businesses.
NEASA has vast experience in opposing the enforcement of bargaining council collective agreements and have already identified several legal arguments to be used against any attempt at enforcement.
We encourage all employers falling within the sector, or who have already been approached by an agent of the Council, to contact NEASA immediately at info@neasa.co.za or visit our website at www.neasa.co.za.
