South Africa’s Employment Equity Act and B-BBEE framework are not neutral policies. They determine who can access employment, government contracts, supply chains, and investment based on race.

Business cannot compete for government tenders without the “correct” racial ownership structure. Government-funded skills programmes are closed to white employees, even where those programmes are funded by white-owned businesses.

Courts have upheld the exclusion of qualified candidates from positions solely on racial grounds. Positions have been left vacant rather than filled by the “wrong” race.

The consequences are not theoretical. Unemployment above 40%. Capital and talent are leaving the country. A procurement system repeatedly linked to corruption rather than genuine upliftment.
