BARGAINING COUNCILS: Compliance Orders: Don’t accept compliance orders at face value.

Employers often view compliance orders as a final obligation to pay.

That, however, is not the case.

When bargaining councils like MIBCO and MEIBC issue compliance orders, many of the amounts they demand are levied by unscrupulous agents and can be significantly reduced, sometimes extinguished completely, through legal technicalities that most employers are unaware of, but which NEASA legal advisors are exceptionally well-trained in.

One example is that of a NEASA member who received a compliance order for R3.9 million. This is the kind of number that can close a business or, at the very least, keep you up at night.

But they contacted NEASA, and based on solid legal arguments, the Bargaining Council completely dismissed the entire amount. Zero Rand was payable.

If you have received a compliance order, do not panic and do not pay without checking the facts.
