On 15 August 2025, the National Employers' Association of South Africa (NEASA) and Sakeliga will appear in the Gauteng Division of the High Court of South Africa (Pretoria) for their urgent legal challenge against the Employment Equity sectoral numerical quotas.
In July 2025, the organisations filed an urgent application seeking an interdict against the implementation of these quotas.
The Employment Equity Act, and the subsequent regulations by the Minister promulgated in the course of 2025, require employers with 50 or more employees to restructure their workforce to reflect national racial and gender demographics by 2030.
The implementation of these quotas is set to begin on 1 September 2025.
NEASA and Sakeliga argue that the Minister failed to follow proper administrative procedures, conducted inadequate consultations and socio-economic impact assessments, and set arbitrary and impossible race-based and gender-based quotas.
The new regulations present significant practical challenges and substantial compliance costs for businesses, justifying urgent legal intervention before the September implementation date.
