Extended Administration and Expenses Agreement Expired…
…BUT WHAT WILL IT TAKE
FOR THE SEIFSA AFFILIATES TO SAY 'NO!'
Dear Industry Employer
On 29 June 2016, SEIFSA affiliates, together with NUMSA, agreed to extend their Admin Levies Agreement to the rest of the Metal Industry – to all the unsuspecting employers and employees not party to that unlawful Agreement.
These SEIFSA-affiliates, collectively representing at most '14 percent' (a measly 14%!) of employers in the Metal Industry, want the rest of the Industry to continue to sustain the MEIBC, while the solvency of the MEIBC is in jeopardy – a fact known to these SEIFSA-affiliates. Even if this unlawful Agreement is enforced, which we doubt will be the case, it will not place the MEIBC in a position to meet its commitments. …contravention of the provisions of the Companies Act
and the Insolvency Act.
This Agreement, which the SEIFSA-affiliates and NUMSA want to enforce upon you, among others:-
is currently challenged by NEASA in the Labour Court on more than 20 grounds. The matter will be heard in October 2016; and
was already been found wanting by the Department of Labour more than a year ago – and nothing was done to rectify it
THEY ARE JUST TRYING THEIR LUCK – AGAIN!
This act by the SEIFSA-affiliates, not surprisingly yielding under pressure from NUMSA again, transpired after we pointed out to them, in great detail, the dire state of the MEIBC and the resultant consequences of giving in to NUMSA's (usual) threats.

In the meantime, employers not affiliated to SEIFSA must cease deducting monies from their employees and paying those as well as their own contributions over to the Council. We will keep you abreast of developments.
