PREPARING FOR STRIKE ACTION
Dear Industry Employer
The parties to the MEIBC are currently engaged in negotiations.
At this stage it is unclear if and when the dispute between the parties will be resolved, but it is likely that the union parties to the MEIBC will be engaging in industrial action at some point in the near future – likely towards next week. We will continuously keep you abreast of developments.
Industrial action within this sector has in the past been characterised by extreme violence, intimidation and damage to property and we do not expect it to be any different this time around. Therefore, it might be necessary for employers to approach the Labour Court for an order interdicting the unions and their supporters from committing these unlawful actions.
PREPARATIONS MADE BY NEASA
These urgent applications tend to be of a highly technical nature and requires a lot of preparation and collection of pertinent information. To this end, NEASA has already geared its litigation division to deal with these applications speedily and efficiently.
ACTIONS TO BE UNDERTAKEN BY EMPLOYERS
We advise employers to, already at this stage, put measures in place which will enable the company to apply for an interdict within the shortest time frame.
Employers are therefore advised to identify individual(s) within their organisation who will take responsibility for the following:-
- Strike committee
- Team leader
- Keeper of strike diary
- Identification of participating employees
- Minute taker
- Document management
- Supervision of video footage/photographs
