On Friday, 14 November 2014, NEASA will return to the Labour Court in Johannesburg for final arguments relating to its urgent application. The application was brought to prevent the Metal and Engineering Industry Bargaining Council (MEIBC) from requesting the Minister of Labour to extend the July 2014 Agreement between the federation Seifsa and trade unions, to parties/employers who were not party to that Agreement.
Following the interim relief which was granted by the Labour Court on 25 September 2014, the Labour Court on 4 November 2014 granted NEASA further interim relief in this matter and a new date for arguments for final relief was set. This interim relief prohibits the MEIBC from approaching the Minister of Labour with a request to extend the July 2014 Agreement to non-parties.
Apart from the fact that the Seifsa/trade union Agreement is detrimental to the Metal Industry, all attempts thus far to extend it was illegal and unconstitutional.
