MEIBC MAIN AGREEMENT

Dear Steel Industry employer
As you are aware, NEASA has challenged the extension of the MEIBC Main Agreement (“the Agreement”) by the Minister of Employment and Labour. NEASA is still awaiting a ruling by the Constitutional Court in respect of the urgent interdict brought against the Bargaining Council which was dismissed by the Labour Court.
Furthermore, NEASA has recently also filed a review application to set aside the decision by the Minister to extend the Agreement to non-parties.
In the meantime, all employers in the Industry must comply with the rates of pay and other conditions of employment contained in the Agreement unless an exemption has been applied for and granted. Council agents are currently enforcing this collective agreement on all employers by way of compliance procedures.
