INCREASE IN BCEA EARNINGS THRESHOLD
Dear employer
The Minister of Employment and Labour has increased the Basic Conditions of Employment Act (BCEA) earnings threshold to R211 596,30 per annum (R17 633 per month), with effect from 1 March 2021.
The effect of this is that the provisions of the BCEA (listed below) are not applicable to employees, whose conditions of employment are governed by the BCEA, and who earns above this threshold:
- ordinary hours of work;
- overtime payment;
- compressed working week;
- averaging of hours;
- meal intervals;
- daily and weekly rest period;
- pay for work on Sundays;
- night shift allowance and the availability of transport after night shift; and
- the provision relating to payment for work on public holidays, only in so far as it relates to work performed by an employee on a public holiday which falls on a day he would normally not have worked.
These are all matters for negotiations between the parties and not enforceable via the BCEA by employees earning above the threshold.
