GOVERNMENT’s INCREASED OBSESSION
with
RACE-BASED LAWS
Dear employer
Labour Minister, Nomakhosazana Meth, in parliament, recently announced plans to significantly expand their inspectorate by increasing the number of inspectors from 2000 to 20 000 through appointing interns as inspectors. This expansion will, according to the Minister, “enhance the inspectorate’s ability” to conduct Employment Equity (EE) audits and inspections.
For the following reasons there is not a single company that does not find the entire EE drive not only frustrating but entirely counterproductive:
no company can afford to steer away from making appointments solely on the basis of merit, regardless of the colour of a person’s skin;
no company can afford to conduct the appointment of its staff on the basis of a predetermined race-orientated scorecard; and
Government’s social reengineering project (EE) does not remotely recognise the complicated intricacies of running a successful business.
In total disregard of the above-mentioned principles, the Minister indicated that they are doubling down on enforcing a race-based ideology which, by its very nature, is harmful to business.
Unfortunately, employers cannot ignore this issue. Being subjected to an inspection, while no steps have been taken to address EE’s dubious demands, may present a company with a legal predicament. All designated employers must therefore address this very challenging issue in a timeous and business-appropriate manner.
