COVID-19: Work from home - Indemnity agreement

Dear employer

The return to work regulations, as published by the Department of Employment and Labour, encourage employers, who are permitted to operate, to allow employees to work from home, where practically possible.

However, there is a risk, in terms of OHS regulations, that the home of the employee may be considered to be the workplace of the employee and, consequently, the employer is obligated to ensure that this workplace is also safe and healthy.

In order to mitigate this risk, NEASA has prepared a draft Indemnity Agreement, in terms of which the employee indemnifies the employer from Covid-19 associated risks and illness for the duration of the work from home period.
