MEMORANDUM OF AGREEMENT: UPDATE

Dear Road Freight employer

In our previous communication we indicated that the MOA signed by the Council does not provide for a set-off clause in respect of advanced payments already made by employers.

We have since been in constant communication with the Council regarding the application for TERS benefits, and have agreed that employers should submit their individual applications directly to the UIF, at least for the period 27 March 2020 to 16 April 2020.

Employers who wish to submit their applications through the Bargaining Council may do so for the period 17 April 2020 to 30 April 2020, provided that they have not paid any benefits other than annual leave to their employees.

Employers who have made use of the NBCRFLI leave advancement provision, at any time during the lockdown period, are advised to reimburse the Council for any funds advanced to employees with inadequate leave balances, once the TERS benefits have been received.
