MEMORANDUM OF AGREEMENT

Dear employer

On 9 April 2020, the National Bargaining Council for the Road Freight and Logistics Industry issued a circular to the Industry informing employers that it had entered into an agreement with the Unemployment Insurance Fund in respect of TERS benefits.

The effect of this agreement is that, once the agreement is extended to non-parties, industry employers, who operate within the registered scope of the NBCRFLI, will be obligated to submit applications to the Bargaining Council to claim Covid-19 TERS benefits on behalf of their employees.

However, it has since come to our attention that the MOA signed by the Council, does not provide for a set-off clause in respect of advanced payments already made by employers. NEASA has informed the Council that we will not be able to support the extension of such an agreement unless it is amended accordingly.

The agreement signed by the Council is not binding until it has been extended, therefore, employers in the sector are advised to submit claims directly to the UIF by sending an e-mail to covid19ters@labour.gov.za and completing the generic MOA (included herein).
