Dear employer
The Compensation for Occupational Injuries and Diseases Amendment Bill proposes amendments that will have far-reaching and devastating consequences for employers, employees and the medical profession.
In terms of section 43 of the Amendment Bill, it is proposed that section 73 of the Compensation for Occupational Injuries and Diseases Act (COIDA) should be amended to the effect that where any medical claim, in terms of COIDA, is ceded to a third party, such a cession will be void.
The practical implication of this amendment would be the complete annihilation of a third-party industry that has allowed the Compensation Fund to retain any semblance of functionality.
