BASIC CONDITIONS OF EMPLOYMENT
EARNINGS THRESHOLD INCREASED
Dear employer
The Department of Employment and Labour has increased the Basic Conditions of Employment Act (BCEA) earnings threshold, with effect from 1 March 2023, to R241 110,59 per annum.
The ‘earning threshold’ in the BCEA provides that certain provisions, e.g., working hours, overtime payment etc. do not apply to employees falling under the BCEA, earning above this threshold.
Earnings for purposes of this threshold is defined as “the regular annual remuneration before deductions, i.e., income tax, pension, medical and similar payments but excluding similar payments (contributions) made by the employer in respect of the employee: Provided that subsistence and transport allowances received, achievement awards and payments for overtime shall not be regarded as remuneration”.
